Amway Quixtar Loses Court Ruling |
Npros.com | 4/23/2010 Amway Quixtar lost a federal court dispute Wednesday to 3 junior independent business owners over an arbitration agreement that Amway makes its IBOs sign when they become distributors. The agreement was described as "unconscionable and unenforceable," according to the Ninth Circuit Court of Appeals. The arbitration agreement essentially forces distributors to reconcile legal disputes privately instead of filing lawsuits in court.The independant business owners succeeded in challenging Quixtar's policy which now makes it possible to sue the company in a court of law, which is the aim of the IBOs as they claim that Amway's Quixtar is a pyramid scheme. Having agreed with the lower court, The Ninth Circuit Court of Appeals said Quixtar's arbitration process is "simply too tainted to be saved through minor adjustments because it is so permeated with unconscionable provisions." In a written response from Quixtar, the company left the following statement: Today's ruling on the arbitration section of the Quixtar contract was expected. The Ninth Circuit historically has been skeptical of contract arbitration. The decision is merely a procedural step on a long road to trial. In fact, the original motion ruling that Quixtar appealed in this case was written more than two years ago. Since that time, concerns about the arbitration process have been fully addressed. We remain confident that a full and fair hearing will validate our view that the allegations in this suit are without merit. |

Chicago Tribune | 12/31/2008 Once a household name and reputedly the key to fortune for modern salesmen hoping to live out a Horatio Alger myth, the Amway brand faded from the American market years ago, tarnished by legal and regulatory problems.The direct seller of everything from health and beauty items to household cleaners repeatedly fought allegations that it was a pyramid scheme. The company also paid $20 million in fines in a Canadian criminal fraud case in 1983. In 2000, after Amway become part of an umbrella company called Alticor Inc., the Amway name was dropped in the U.S. and Canada. The hope was that the company could emerge remade in the world of online sales under a new moniker: Quixtar. Now, as Amway's 50th anniversary approaches in May, Alticor is retiring the inert Quixtar label and pouring millions of dollars into reviving the Amway brand in North America with market research, national TV commercials and ads in newspapers, magazines and online. The company will use a transitional name, Amway Global, before reverting in about a year to Amway. |

Amway cautions individuals to be on the lookout for e-mails from a group calling itself the "Amway Children Charity Foundation". Please be advised that this is not an Amway-sanctioned program and the name, program and people indicated in the e-mails are not related to Amway in any way and do not have Amway's authority or support.The goal of the scam is to trick people into sending money to the fraudulent charity. The bogus group sends an e-mail informing the recipient that he/she has been selected as a recipient of a grant to help establish a children's help center to assist poor children in the area. A nomination code number may be given, and banking information is requested. If the recipient responds, an indemnity bond of several hundred euros is demanded. The e-mails may be signed from "Dr. Kevin Brown" or someone else claiming to be a grant processing officer. Fraudulent activities involving payment or release of personal financial information can be committed electronically from a remote location, including overseas. Committing these activities in cyberspace allows scam artists to act quickly and cover their tracks before the victim becomes aware of the theft. |

The suit, filed by Quixtar, the online version of Alticor Inc.'s Amway business, asks the court for an injunction and damages of more than $25,000 against the anonymous posters. The company is planning to ask the court to approve subpoenas of companies ranging from godaddy.com to YouTube to figure out who posted the materials, said spokesman Rob Zeiger. The company believes the videos and other postings are part of an organized effort by former distributors, including Orrin Woodward, of Grand Blanc, under court order not to disparage the company or disclose proprietary information. "Quixtar has attempted to identify the various defendants by reviewing the offending Web sites, blogs and videos," according to the suit. "Due to the policies of the Internet service providers, which host the various Web sites, blogs and videos, Quixtar has been unable to identify the responsible parties." |

Grand Haven Tribune | 10/8/2007 A judge has ruled in favor of Quixtar Inc. in three lawsuits involving several of the direct marketer's former distributors, saying Friday they must abide by confidentiality and noncompete clauses until their disagreements with the company can be arbitrated.Quixtar is the name that Alticor Inc. uses for its U.S. and Canadian direct sales unit that is known elsewhere as Amway Corp. Alticor, which is based in Kent County's Ada Township, announced in June that it will start phasing out the Quixtar name and rebuilding its Amway brand in the United States and Canada. Kent County Circuit Judge Paul Sullivan issued a preliminary injunction that prohibits the former distributors, which the company refers to as independent business owners, from using their former Quixtar networks for any business-related purpose. |

Brady and Woodward had a disagreement with Quixtar and wanted to be released from their "no compete" clause in their contracts. Several other high-ranking Quixtar members joined them as well. |
